Intellectual Property Policy

Effective Date: January 01, 2024
Last Updated: October 13, 2026

1. Introduction

APPUPNEXT respects intellectual property rights and is committed to protecting its own intellectual assets while respecting the lawful rights of customers, developers, sellers, business partners, and other rights holders.

APPUPNEXT started its business journey in 2018 and provides website templates, software solutions, e-commerce platforms, website development, UI/UX design, graphic design, AI-based solutions, automation systems, and other technology-related products and services to customers worldwide.

This Intellectual Property Policy explains the ownership, permitted use, licensing, protection, and reporting of intellectual property associated with APPUPNEXT products, services, platforms, and business operations.

By accessing or using APPUPNEXT products or services, users agree to comply with this policy and all applicable licensing terms, contractual obligations, and legal requirements.

2. Scope of Intellectual Property

Intellectual property associated with APPUPNEXT may include, but is not limited to:

  • Website designs, themes, templates, and layouts.

  • Software, source code, scripts, applications, and algorithms.

  • Graphics, illustrations, icons, photographs, and visual assets.

  • Logos, trademarks, trade names, and brand identities.

  • Written content, documentation, tutorials, and publications.

  • Videos, animations, audio, and multimedia materials.

  • UI/UX designs, prototypes, and interface components.

  • Database structures, original compilations, and technical documentation.

  • Marketing materials, product descriptions, and promotional content.

  • AI-assisted or AI-generated materials to the extent protected by applicable law or contractual rights.

  • Proprietary methods, trade secrets, and confidential business information.

  • Other original creative, technical, or commercial materials.

Ownership and permitted use depend on the nature of the material, the applicable law, any third-party rights, and the relevant license or written agreement.

3. Ownership of APPUPNEXT Intellectual Property

Unless expressly stated otherwise in a valid written agreement, intellectual property created, developed, acquired, or lawfully licensed by APPUPNEXT remains the property of APPUPNEXT or the relevant rights holder.

The APPUPNEXT name, logo, website content, branding, original designs, proprietary software, documentation, and other protected materials may not be copied, modified, distributed, reproduced, or commercially exploited without appropriate authorization.

Accessing a website, purchasing a product, or receiving a digital download does not automatically transfer copyright, trademark ownership, source-code ownership, or other intellectual property rights.

Customers receive only the rights expressly granted under the applicable product license, service agreement, or written authorization.

4. Copyright Protection

Copyright may protect original works such as software code, website designs, graphics, written content, videos, documentation, and other creative materials, subject to applicable law.

Users must not reproduce, publish, distribute, sell, sublicense, or publicly display copyrighted materials beyond the permissions granted by the relevant rights holder.

Unauthorized activities may include:

  • Copying and reselling APPUPNEXT themes or templates without permission.

  • Republishing proprietary documentation as one's own work.

  • Distributing licensed source code to unauthorized parties.

  • Copying original graphics, illustrations, or marketing materials.

  • Removing copyright notices or ownership information.

  • Uploading or sharing protected files through unauthorized channels.

  • Creating and selling unauthorized copies of paid digital products.

Permitted use may vary depending on the product license and any exceptions provided by applicable law.

5. Software and Source-Code Rights

APPUPNEXT may provide software, website templates, themes, scripts, plugins, applications, and source-code packages under different licensing arrangements.

A purchase may grant a limited right to use a product without transferring ownership of its underlying intellectual property.

Depending on the applicable package and license, customers may receive permission to install, configure, modify, or use a product for specified purposes.

Unless expressly authorized, customers must not:

  • Redistribute or resell the original software or source-code package.

  • Sublicense the product to unauthorized third parties.

  • Remove or bypass license verification or technical restrictions.

  • Claim ownership of code or materials belonging to APPUPNEXT or another rights holder.

  • Publish proprietary source code in a public repository.

  • Use a product outside the permitted installation, project, or user limits.

  • Circumvent access restrictions or other lawful licensing controls.

Specific rights regarding source-code access, modification, redistribution, commercial use, and transfer are governed by the applicable Software License Policy and purchase agreement.

6. Website Themes, Templates, and Digital Products

APPUPNEXT may offer ready-made themes, website templates, graphics, software packages, and other digital products for personal, business, or commercial use according to their respective licenses.

Customers must review the product description and license terms before purchasing or using a digital product.

Unless expressly permitted by the applicable license, purchasing a digital product does not authorize customers to:

  • Sell or redistribute the original product files.

  • Offer the product as a competing template or download service.

  • Share paid files with unauthorized users.

  • Repackage the product for resale.

  • Remove attribution or licensing information where retention is required.

  • Claim exclusive ownership of materials that remain owned by APPUPNEXT or a third party.

Where a product contains third-party components, additional licensing terms may apply.

7. Custom Development Projects

Intellectual property rights for custom websites, software applications, e-commerce platforms, graphics, and other commissioned work depend on the relevant quotation, work order, contract, license, and payment conditions.

Before a project begins, APPUPNEXT and the customer should clarify, where applicable:

  • Ownership of newly created deliverables.

  • Source-code delivery and access rights.

  • Rights to modify or maintain the deliverables.

  • Rights to use the deliverables commercially.

  • Ownership of pre-existing code, frameworks, libraries, and tools.

  • Third-party assets and licensing obligations.

  • Any restrictions on resale, redistribution, or transfer.

Unless expressly agreed otherwise in writing, pre-existing APPUPNEXT tools, reusable components, frameworks, libraries, development methods, and proprietary materials remain subject to their existing ownership and licensing arrangements.

Payment for development services does not, by itself, establish that every underlying component or third-party asset is transferred to the customer.

Any ownership transfer or exclusive license must be documented in the applicable agreement and interpreted according to relevant law.

8. Customer-Supplied Materials

Customers may provide logos, images, text, videos, product information, fonts, trademarks, software, and other materials for use in a project or service.

Customers represent that they have the necessary rights, permissions, and legal authority to provide those materials for the intended purpose.

APPUPNEXT may use customer-supplied materials only as reasonably necessary to perform the agreed services or as otherwise authorized.

Customers remain responsible for obtaining appropriate permissions for materials they submit, including materials owned by third parties.

APPUPNEXT may refuse to use, remove, or request replacement of materials when there is a reasonable concern about infringement, unlawful content, or lack of authorization.

9. Third-Party Intellectual Property

Certain APPUPNEXT products and services may include or depend on third-party software, plugins, frameworks, fonts, images, APIs, libraries, open-source components, or other licensed materials.

Such materials remain subject to their respective ownership rights and license conditions.

Customers must comply with applicable third-party requirements, which may include attribution, source-code disclosure, usage restrictions, distribution conditions, subscription fees, or other obligations.

APPUPNEXT does not claim ownership of third-party intellectual property merely because it is integrated into a product or service.

Where third-party license terms conflict with assumptions about product ownership or use, the applicable license must be reviewed before the material is used or redistributed.

10. Trademarks, Brand Names, and Logos

The APPUPNEXT name, logo, and associated brand identifiers may be protected by trademark, copyright, or other applicable laws.

Users must not use APPUPNEXT branding in a manner that falsely suggests sponsorship, endorsement, partnership, authorization, or official affiliation.

Unauthorized use of company logos, trade names, or brand assets in commercial materials, advertisements, products, or websites may be restricted.

References to APPUPNEXT for legitimate identification, commentary, or other lawful purposes must not mislead the public or violate applicable trademark rules.

Third-party brand names and logos appearing on APPUPNEXT platforms belong to their respective owners.

11. AI-Generated and AI-Assisted Materials

APPUPNEXT may use artificial intelligence tools in certain design, development, content creation, automation, and software-related workflows.

The intellectual property status of AI-generated or AI-assisted materials depends on applicable law, the degree of human contribution, the terms of the relevant AI service, and any third-party rights involved.

APPUPNEXT does not guarantee that every AI-generated output is eligible for copyright protection, exclusive ownership, or unrestricted commercial use.

Customers using AI-assisted materials are responsible for reviewing relevant licensing requirements and ensuring that their intended use does not infringe third-party rights.

Where a project requires original, exclusive, or legally cleared materials, the parties should expressly document the applicable requirements and responsibilities.

12. Open-Source Software

APPUPNEXT may use or distribute open-source software as part of its technology products and services.

Open-source components are governed by their respective licenses, which may permit use, modification, or redistribution subject to specified conditions.

Some licenses may require attribution, preservation of notices, disclosure of modifications, or distribution of corresponding source code under particular circumstances.

Customers must comply with the licenses applicable to the components they use or distribute.

APPUPNEXT's proprietary rights in its own materials do not override the rights granted by applicable open-source licenses.

13. Prohibited Intellectual Property Activities

Users must not engage in activities that violate intellectual property rights, including:

  • Unauthorized copying or distribution of protected materials.

  • Selling counterfeit or unlawfully copied digital products.

  • Using another party's trademarks to mislead customers.

  • Removing required copyright, trademark, or license notices.

  • Claiming ownership of another person's original work.

  • Publishing confidential source code or proprietary files without authorization.

  • Circumventing lawful licensing restrictions.

  • Submitting infringing materials for development or publication.

  • Misusing APPUPNEXT products to facilitate infringement.

  • Falsely reporting legitimate materials as infringing.

APPUPNEXT may investigate credible reports and take reasonable action consistent with applicable law, contractual obligations, and the circumstances.

14. Reporting Intellectual Property Infringement

Rights holders or authorized representatives who believe that material available through an APPUPNEXT platform infringes their intellectual property may submit a report through an official APPUPNEXT communication channel.

A report should include:

  1. The name and contact information of the reporting party.

  2. Identification of the copyrighted work, trademark, or other protected material.

  3. The specific URL, product, listing, or content alleged to be infringing.

  4. An explanation of the alleged infringement.

  5. Evidence of ownership or authority to act on behalf of the rights holder, where reasonably available.

  6. A statement that the information provided is accurate to the best of the reporting party's knowledge.

  7. Any additional information reasonably necessary to investigate the claim.

APPUPNEXT may request clarification or supporting documentation before taking action.

Submitting a complaint does not automatically establish that infringement has occurred.

15. Review and Resolution of Infringement Claims

APPUPNEXT may review reported materials and assess the information supplied by the parties.

Depending on the circumstances, APPUPNEXT may:

  • Request additional evidence or clarification.

  • Temporarily restrict access to disputed material where appropriate.

  • Remove or disable access to material when justified.

  • Contact the relevant customer, developer, seller, or rights holder.

  • Request proof of authorization or licensing.

  • Restore material if the claim is withdrawn or the available evidence does not justify continued restrictions.

  • Take other reasonable steps consistent with applicable law.

APPUPNEXT aims to handle intellectual property complaints fairly and does not guarantee a particular outcome before reviewing the available evidence.

16. Counter-Notifications and Disputes

A person whose material has been restricted or removed may contact APPUPNEXT to explain why they believe the action was mistaken or the material is lawfully authorized.

A response should identify the disputed material, provide relevant evidence, and include any license, permission, ownership information, or other supporting documentation.

APPUPNEXT may review the response and determine whether further action is appropriate.

Where a dispute cannot be resolved through ordinary communication, the parties may pursue remedies available under applicable law.

Nothing in this policy prevents a rights holder or affected user from exercising lawful rights.

17. Confidential Information and Trade Secrets

Customers, developers, employees, contractors, and business partners may receive access to confidential information during their dealings with APPUPNEXT.

Confidential information may include source code, business plans, pricing arrangements, technical documentation, credentials, customer data, proprietary processes, and non-public commercial information.

Recipients must use such information only for authorized purposes and protect it against unauthorized disclosure, subject to applicable agreements and law.

Confidential information must not be copied, disclosed, published, or commercially exploited without authorization, except where disclosure is legally required or otherwise permitted.

Any additional confidentiality obligations will be governed by the applicable non-disclosure agreement, employment agreement, service contract, or other written arrangement.

18. Intellectual Property in User-Generated Content

Customers, developers, sellers, and other users may submit product listings, descriptions, reviews, images, software, designs, or other content through APPUPNEXT platforms.

Unless otherwise agreed or required by law, users retain the rights they hold in their original content.

By submitting content, users authorize APPUPNEXT to host, store, display, reproduce, format, and otherwise process that content as reasonably necessary to operate the platform and provide the requested services, subject to the applicable terms and privacy requirements.

Any broader promotional or commercial use requiring additional permission will be handled according to the relevant agreement and applicable law.

Users must not submit content that infringes another person's intellectual property rights.

19. Enforcement and Account Restrictions

APPUPNEXT may take proportionate action when credible evidence indicates that a user has violated this policy or infringed intellectual property rights.

Depending on the circumstances, action may include:

  • Issuing a warning.

  • Requesting removal or correction of content.

  • Restricting access to disputed materials.

  • Suspending affected listings or product access.

  • Temporarily restricting an account.

  • Terminating access where justified under the applicable agreement.

  • Cooperating with lawful requests from relevant authorities.

Actions will be considered in light of the available evidence, the seriousness of the alleged violation, applicable law, and any relevant contractual commitments.

20. No Automatic Transfer of Rights

Purchasing, downloading, installing, or subscribing to an APPUPNEXT product does not automatically transfer ownership of the product or its underlying intellectual property.

Likewise, receiving a website, application, graphic, or other deliverable does not necessarily transfer all rights in pre-existing code, frameworks, stock assets, fonts, plugins, or third-party components.

Customers should review the relevant product license, quotation, work order, and Software License Policy to determine the exact rights granted.

Where exclusive ownership or a transfer of rights is required, the arrangement should be expressly documented in writing.

21. Limitation of Responsibility

APPUPNEXT makes reasonable efforts to respect intellectual property rights in the products and services it provides.

However, third-party content, user submissions, external platforms, and independently supplied materials may be subject to separate ownership rights and licensing conditions.

To the extent permitted by law and the applicable agreement, APPUPNEXT is not responsible for unauthorized uses of intellectual property by customers or other third parties outside its reasonable control.

Nothing in this policy excludes liability or obligations that cannot lawfully be excluded or limited.

22. Policy Updates

APPUPNEXT may revise this Intellectual Property Policy to reflect changes in its products, services, technology, licensing practices, or applicable legal requirements.

The latest revision date will appear at the beginning of this document.

Policy updates will not automatically override existing written agreements or mandatory legal rights.

Users are encouraged to review this policy periodically.
